Update from Aurora: Judge Denies Temporary Restraining Order Preventing Eviction of Registrants
Today, a Kane County Illinois judge denied a temporary restraining order against the city of Aurora’s eviction of 18 sex offenders from the Wayside Cross Ministries halfway house. The City claimed they can’t live there because it is less than 500 feet from a city playground and park.
Mark Weinberg, one of the attorneys representing the men said that he was prepared to appeal the decision all the way to the US Supreme Court.
We will supplement this news as soon as more comes in.
If I remember right, a federal court already denied this eviction order. The reason why is really immaterial – if the order violates federal law, there’s no state law that can overturn that. What ever happened to state law giving way to federal law?
It happened when our country became divided and not an actual united one, States haven’t abided by Federal laws for decades, and will continue to do so until actually forced into obeying.
The Wayside Cross is registered as a CHURCH! The men living at Wayside Cross attend religious services and counseling. They are not to leave the building or have use of a cell phone. Once evicted, they no longer will be held to these standards. To keep warm, they may ride Aurora buses all day long. The Wayside Cross is on the east side of Aurora. East Aurora School District 131 does not have school buses. The children use city buses. So this eviction will likely bring a union of sex-offenders and District 131 students together! Oh, and “playground” nearby? There are no slides, no monkey bars, no swings. The park is not near housing. The two springy teeter-totter pieces were placed in the empty park only a few months ago. The only time children ever sat on them is for the photo shoot. The placement of the playground equipment was a move by the city in retaliation because the Wayside Cross would not evict the brother of a serial killer from the mission. The irony is this man was only convicted of murder as an accomplice to his brother. He is not a sex-offender so can sit on that teeter-totter in the park all day long!
