There was mention that “the punishment should fit the crime,” and that offenders should be “held accountable.” This was followed by video clips of prisons, which equates the registry with punishment. Registrants have already been held accountable and been punished for their crimes. That is the judicial part.
This was a good report. But at no time did the reporter, or the ACLU lawyer, point out that the registry is not considered punishment. A criminal law must specify the punishment for a violation. I’m not aware of any statute that specifies registration as punishment. I wish that it would be added to one. It would make punishment unambiguous and the ex post facto argument much easier.
