SB 234 presented to Governor
If you’ve been following this forum during the past legislative session you will know that Senate Bill 234 has been on our radar and we’ve raised several calls to action opposing a lot of the horrible stuff that was in there.
Our efforts made a significant difference as the version of SB 234 that was signed off on yesterday and presented to the Governor is devoid of the changes to the registration laws that we were fighting against.

FAC and members intervened to block what would have been a ridiculous and extremely burdensome definition of a “day” which, in theory, could have required us to register not only places where we actually reside, but merely visit, 3 or more days per year. All of that language was removed at the last minute and the bill, as passed, affects literally only one person, who will now have to register. The actual details are irrelevant to almost everyone else because his case was very unusual. It involved the fact that he had not payed a fine which under the previous definition of terms meant he was not “released” and therefore not subject to registration. It is more a reflection of how poorly written the Florida sex offender registration laws are than anything else.

Most people will not address your question as it against Florida law to dispense legal advice when not a lawyer.
However, all crimes in Florida are right out of the Florida Statutes and any crime your friend is charged with will list the Florida statute number assigned to it. Then all you need to do is spend 15-20 minutes reading the Florida Statutes to determine if that is one of the crimes/codes that if found guilty, would require registration.

What do you mean by “irrelevant (except to one person)”?
The bad stuff: Was that the time-sharing threat where a person on the registry could lose custody of their children in a divorce? Part of a day became a day? What else?

The changed definition of day was also omitted.
Please reference the last update on this bill, in which we wrote, “On Friday, Amendment 122135 was filed as part of Senate Bill 234, which addressed State v. James, 298 So. 3d 90 (Fla. 2d DCA 2020) (the case that said someone who has not paid their fee has no requirement to register), but removed the parts of the bill that state, “A day includes any part of a calendar day.” If the language that concerned us the most (having to register places where we were present for only parts of a day), is gone, this is great news!
As it turned out, the concerning language in THIS BILL having to do with the change in “day” is out for good and this is good new.
I think it’s a shame they removed the definition of “day.” I know FAC disagrees, but I would have liked to see the reaction at the registry offices when every registrant goes to register virtually the entire phone book.

Did they remove the option to register vehicle info online through the web portal? The original bill included it, which would be very convenient.

You know why I like FAC over the other advocacy groups as the word “Action” denotes either a positive or a negative. In fact that was the word they used on me in my ordeal “Action”. Even these bills appear to be a negative type of action to defend their honor, i. e. court systems, leglislature btu it is no better than someone holding a knee to someones neck in this sexual triumph.
Guess one could say muddy wsaters break a lot of dams’ today when everyone wants to triumph over say, its all about the database, all about one’s sexual make up, all about this or that. Actually its all about “Control” in many unjust ways. These bills and these issues are all out of the book or are we all a rebel without a cause.

The feds have been in this game for more than a decade. Hardly a week goes by without one of these being posted. The U.S. Marshals lack funds to do their jobs because they spend so much time on people who are not committing crimes.
I wonder what would happen if all sex offenders in Florida put the governors and the lawmakers of florida’s address down as their temporary address. How soon do you think the laws would change?

I have been out 9 years now. I have been successful in my life. Ive been following florida action since ive been out. There has been nothing seem to change in florida. I had to make it with out help from the state in the laws changing. Everyday I check for new updates with little hope of anything changing, I have worked my ass off to get where I am at. My hope for change has almost diminished. I have a new house with my wife of 26 years, Everyday I pray of no confrontation from neighbors finding out. 2 years coming up in October living here. Covid was a blessing. I haven’t seen a officer in over a year for a residency check in Volusia county.

Havent missed a beat. The city cops come by tell me i need to sign and i need to be home (off probation in my home state in 2001) no paper whatsoever, tell my wife if im not home they can arrest me and i need to be there for my three month review as they call it.
I do my travel paper thing with sheriffs dept every month as i go home to my state a few days and once they came by told me i can get arrested for that if i dont tell my detective: i dont HAVE a detective….
I just want to live in peace with my children. NEVER had ANY sanctions ANYWHERE until i came here. I wasnt on a public registry and now: ruined life.
So, you moved to FL from…? And where else have you lived that you had no sanctions and how did you end up on FL’s registry?
Northeast: level 1 never on the public registry: actually did not make any level until the law changed and was made a 1. came here on business to purchase some homes I advised my home state just in case and they were ok as i had absolutely no restrictions. Got arrested we showed my proofs and the case was put “no information” But when i was in jail that night, the corrections captain put me on the registery before release. Again, no arraignment as they filed a no information and I actually had a flight home i missed because of that. Figured my life was ruined anyway and stayed.
JM, what did you get arrested for? I’m just trying to get info on FL more so than on you personally. So you’re home state contacted FL and told them you were there? Ah… but you were still required to register (even without restrictions) in your home state? Is that it?
Federal case: only probation: off paper 2001: only on non public registery (got a note im no longer required to register in my home state as its expired)
Nope home state was contacted by vcso and they backed my story which is why the no information was filed. I had no travel restrictions or reporting requirements.
It was for a FTR herein fl but again it wasnt even sent to arraignment it was all dropped before anything even happend. My registration happened the night i was being processed and by the corrections officer. No judge no anything. My flight was that next morning already booked etc. i had been here a few times but had no idea about that rule. Noone in my state even knew. Funny thing is my fdlepaper states no residency restrictions (1996 it happened) either. Never saw a judge or was explained this whole mess. Literally a no information was filed by the prosecutor immediately after. Never saw the inside of a court. Got my bond back in a week. Im off in my original state but on for life because i was here.
I hear you in that I wish it would all just go away. today. But that is not the reality about how the judicial changes happen and nor about changing how the public sees us . it takes time . not days.
and if you have been checking FAC daily you will have seen how they and the membership have prevented worse laws from passing.
It is hard to not lose hope. But once that is gone, the fight in you also goes . and that is when change stops. Hang in there . Keep hoping. More importantly volunteer so you can keep fighting. That is what has stopped worsening laws. that is what is beginning to change minds . get involved!. keep fighting!
At times one can be confused with all this traction of malice. Although its time to put some action in all diabolical discovery across the USA. Now don’t quote me or anyone on this but this registry is a little peyton place and who’s the harper valley hypocrites.
A bill here there and a bill over their even going back to a retroactive status to review all this prison or probation lifetime offender drama or who is getting the worst of the worst in all this made for a drama court ordeal. Are authorities going above their league with a Barney bad ass type of come down and lets get naked, or you thought you were going to meet a teenager, which is the whole motive behind all this push comes to shove.
So who’s protecting who with this ill gotten gain in many states or judicial courtrooms. Authorities are just as guilty for even pressing these ordeals on another, or were is the warning signs when truth comes to shove or are authorities taking things out of context in this blind judgment call. Wreckless endangerment of who? Would not authorities be just as wreckless or are many at a stale mate in this chess game of sexual oversight. Advantages or disadvantages. Who’s making common sense in government.
