Florida’s 2nd DCA says Police Sting entrapped Defendant

Jason DeMare went on an ADULT website and initiated contact with AN ADULT. For days, they chatted and flirted while he believed the woman was 18, but on the fourth day she told him she was 14. She was neither 14 nor 18 and she was not a flirty female but an undercover officer. Each time DeMare tried to steer the conversation away from sex, the officer tried to steer it back. Each time he said he was not interested in a sexual relationship with a minor, the officer kept cajoling him and calling him chicken.

Sound familiar? It’s pretty much the playbook for these “stings”/”scams” run by Florida police departments. When I first heard some members tell me this story, I thought “yeah right”, but when I heard the same story over, and over, and over and read the transcripts in Trey Gennette’s case, I couldn’t believe law enforcement would get away with this and just how often they used these tactics to bait and switch someone into a manufactured felony.

When I asked why they took the plea? it was always because they were threatened with decades in prison if they didn’t.

There have been a few brave souls who put their foot down and took their chances in court. One such brave soul is DeMare. You can read his decision here:

    These shiteaters shouldn’t and don’t have the right to be even “sting” operations. Blatant violation of the 1st, 4th,5th amendments to the constitution… Being on a ADULT WEBSITE, means just that. These psychopaths get away with anything….

      I still want them to explain the reasoning of how someone who goes to adult sites and chat rooms are somehow child predators. I seriously doubt ACTUAL child predators are lurking there on the off chance they run into a minor. Shouldn’t they be stalking the child chat rooms if that’s what they’re looking for? Just saying…

    Does DeMare have any civil recourse at this time? Because, personally, I would be calling every Shyster and Shyster law firm in the book trying to sue for damages. This took away over 2 years from Mr. DeMare’s life, which must have been a living nightmare for him!

    I believe that we must start trying to hold law enforcement (and the courts) as accountable as we can – really hold their feet to the fire!

    I know that this is a big topic of conversation in the current #BlackLivesMatter movement for police reform.

    PS: Wouldn’t it be ironic if he found himself stuck on the registry because they refused to now remove him?

      there have been a few unsuccessful attemps to file civil suits from sting related cases. There is no constitutional right to be free from entrapment so you have to approach it by other means which did not happen in one of the cases for sure. Not one individual case is going to change the course of stings……its the overwhelming evidence from numerous cases and research that would need to be presented to a proper court requesting an injunction. Injunction is the legal means to at least temporarily halt stings and force the DOJ to investigate given the overwhelming amount of evidence that shows these stings are wrong. Its really not that hard to do, its just hard finding the legal help to do so. Hell, i’ve written a rough draft injunction myself but something of this nature would have little chance of success filing pro-se.

    Yes, My case was vey similar. I hied one of the attys that woked on the Casey Anthony case. I was in caigs listlooking for a used dishwasher. A peson that I was communicating with said he had abused his child sexually and what did I think. I asked why and wanted to dop it. He insisted talking about it so I thought i could “Out” him. I was neve in touch with any child. Just this man who said he had a child. To try and lure him i showed interest. Wrong Move !!!

    Turns out the man was an officer in Oange County. Thee was No child, the child was fictitious. So I am a sex offender with a child that did not exist. In fact on one of my cout papes whee it descibed the VICTUM it says ” No Known identifiable victum”

      never try to beat them at their own game nor would any attorney advise you to do so as well. It’s a dirty deed they are doing and ruining lives. Those arrested are the true victims and out of all the cases that i’ve reviewed, which are numerous, very seldom is anyone seeking to do anything harmful to a minor. Its a scam called “cooking the books” I’ve written about this time and time again

    Why is Florida law enforcement allowed to create “criminals” where there were none?

    Isn’t there real crime out there without making it up…or is it the “easy fruit” aspect of the “lazy” cop?

    No – it is simply that the political power in Florida uses the fear factor of “sex offenders” to manipulate the public. Sex offenders are the common enemy that they can rally support against and distract from real issues and problems.

    Couple that with the monetary incentive of creating a type of “criminal” that is a criminal for LIFE and therefore makes money for the state for LIFE!

    Senator Lauren Book and her father lobbyist Ron Book exploit this to support their lifestyles. They profit from spreading hate.

    Follow the money and you will find the ugly truth.

    I’ve been saying for 2 years now that these sex sting operations where police go to adult sites to supposedly catch “child predators” are a huge scam. We know it’s all about money.
    Check out the podcast on Wrongful Convictions, False Confessions. What police do in these sex sting operations is just a more mild form of the tactics they use to force false confessions. In fact, some of them, after trapping victims in this scam, will use those more extreme, evil tactics to force false confessions to make these victims they trapped look like the child predators they desperately want to make them look like. We have proof of this.
    We also know that there are many prosecutors, defense attorneys, and even so-called professional expert witnesses (possibly even some judges) that are a part of this scam too. There’s money and opportunities for job boosts for many people in this scam. They also use these same tactics that police use to force these wrongful convictions. It’s pretty much gaslighting. It’s what evil, entitled people who desperately want to get their way will do to convince others that the fantasies they have created are real.
    We also know that hiding important evidence and other important information is another tactic they use to force the convictions of these completely created by them cases.

    Now that there is no doubt left that this is indeed a scam, something even worse is that I truly think this is also a part of a cover up for actual child predators and for the sex trafficking business. I’ve been saying that for a long time. Someone needs to really look into that. At least, here in Texas there are signs that certainly make it look that way.

    Yea but who will actually help these ones without costing arm and leg a person is out now for 18 month just got a new probation officer and a family member from a different state called to p.o. she say she believes the female over him but she claim he was in a video chat with her kids plus p.o. said he needs to pay restitution he try to tell her they waived that no victim she said you must of had a victim so they are just a way for officers to keep putting in jail to collect the grants money most of people in fl are from the sting and 2 sheriffes said no one will ever stop them.

      There was a retired deputy sheriff that came up here from Florida.
      He was going to the same Church I was at the time.
      There was a Bible study at my girlfriend’s house and he approached her and said emphatically, out-of -the-blue, how much he hated sex offenders.
      About six months later someone went around her neighborhood and told all the people around her that I was a sex offender which included someone else who went to the same Church that lived close by.
      Then that one who lived close to her told the Church leaders later, and to avoid any fall-out that was going to occur and DID occur (although I saw it coming beforehand) I left that Church.
      All the evidence points that it was the retired deputy sheriff from Florida who dropped the first bomb in her neighborhood.
      The LORD judge between him and me.
      There was also a part-time cop that lived near her, but as I said, hearing about how much sheriffs in Florida hate people with sex offenses, and after what he said to my girlfriend, I believe it was the retired deputy sheriff from florida that caused all this grief and trauma I am still suffering from.

    There are currently no resources to help with these stings – they have put thousands of innocent men in prison, some actually for LIFE! Lifetime parole, lifetime registration. It’s a complete government money scam.
    This is very real people, we need to get this word out. No lawyers are up to the task for fear of reprisal, the LE and prosecutors get funding per arrest! They are not going to stop until we stop them! All the while the police are parading innocent men in these stings as if they are keeping us all SAFE!!!! What? Keeping us safe from innocent men???

      These are federally funded. They are required to make more arrests each funding cycle in order to be eligible for more funding.

      This isn’t JUST the State, but your Federal Tax dollars at work.

          These big government agencies obviously have way, way too many resources. Just take a look at the Registry Hit Lists! Who ever dreamed that was acceptable in America?! Who are the people who think the Hit Lists are anything other than just harassing, idiotic, immoral, completely out-of-control, nonsense, nanny big government? Who are those people?! They aren’t Americans.

          I’ll tell you what won’t work – leaving it to the law enforcement criminals (LECs) to ask them if we should have Hit Lists or not. They want just about ANYTHING that will bring them more $$$$$ and jobs for low lives. Their opinions are invalid. And frankly, it ought to be completely illegal to have these mob police agencies allowed to lobby for anything related to the big government incarceration business. They are always going to ask for more stupidity to get more customers. Always.

          Take a look at any LEC budget, probably anywhere. They are way too big. Get involved and let’s take their slush fund from them. They’ve had way too much power forever and look at the stupidity that has resulted. Let’s force them to concentrate on actual crime prevention and solving. The extra nonsense must stop.

          Interesting how you spelled “de-fund”. A lot of spell checkers will flag “defund”. But I think “defund” is okay. It is in numerous dictionaries and is in common usage. I’ll often use words that aren’t technically correct, but I like them and people understand them.

        Most lesbians, including those reading these comments or supporting this movement, would dispute this characterization of them.

        And anyone who has undergone the type of sexual abuse described here, is not a worse person because of it. I certainly wouldn’t attack someone for being a survivor.

        I do agree that one of the main reasons sheriffs engage in these stings, is that their departments receive funding to do so. Another reason is that they’re easier and cheaper than clearing actual abuse cases. But once we start claiming that they’re abuse victims themselves, and that that abuse is their motivation for doing this, we start to garner sympathy for THEIR cause, not ours.

    My son had similar tactics in 2008 and subsicrently went to prison. He was approached in the Adult Club Chat room. He is legally deaf, and told the “female” same and gave her his cell number and e mail. She called him several nights and asked him to do sexual things and he refused. He got so tired he did them. Went to meet her and went to prison. This man had never been in a police staton before and was extremely afraid. He told them a story and they believed him and was prosicuted for it also. He was just trying to give them a story to let him go HO M E. He didn’t really hear the Miranda and knew what it meant. I lost two cars, my home, and he went to hell and back in prison. This is a man who is very talente with mechanics, worked on the Space Shuttle etc. When he was finally realeased after being threatened numerous times in prison, I had to purchase a Manuf. home in a low income section. Also his first probation officer wanted $250.00 a month. Where was he going to get that just be3ing realeased from prison. I pawned all my jewelry to meet the payments for about 6 months. The new Prob. officer reduced the amount. He was given 5 and 5/ At one point, they asked for 5 and 10/ I said in cout, what happened to the 5 and 5? then they relented. He is now out. But with the registration is followed, stuck with needlees, etc. Those are the things the probationers won’t talk about. This was a distinct case of Entrapment.

    Similar situation happened to me. Lawyers merely took my money. Even though I told my lawyers that the chats would show entrapment, not one of them were able to get the chat logs.     I mean, anyone can be a child predator. I expect most child predators probably like adults as well and would visit these chat rooms more than just an “average” person would.

    But these stings, I don’t know what I think about them. If they are done legitimately, e.g. the law enforcement criminals (LECs) don’t entrap people, I don’t think I have much of a problem with them. Are these stings useful? Maybe. But surely very little. I fully expect that the most skilled child predators would never, ever, ever just start talking to a random person in a chat room. So the people that these LECs are catching are not actually any people we actually need to worry about. I expect of the people who are caught like this, that a good 99.999% of them are not dangerous at all to a good parent actually being a responsible parent and protecting their children.

    But really, I doubt these stings have very much to do with preventing child abuse. I think, like a lot of things, they have a lot more to do with just making LECs feel a little bit better about themselves. I think most LECs need their egos stroked on a regular basis. I believe most of them have low self-esteem. Pretending to care about children and child abuse, more than just any normal person does, makes them feel better. It improves their fragile self-image. I really do think that is THE KEY motivation behind nearly all of these stings and “save children” organizations.

    The other motivation is $$$, of course. LECs are constantly trying to drag new customers into their big government incarceration business. They love getting new customers in, that they can keep involved and coming back for decades. The Registry Hit Lists help them perfectly with that. The incarceration business is the real reason for stings and the Hit Lists.

    Mine was in lake city, it was with a 34 year old woman on Craig’s list intimate encounters.public defender without seeing my case told me he wasnt gonna help me cause he didnt like my case and cases like mine. He would tell my family to do things to clear my name to keep them busy and refuse to use it when they got the information he needed. He lied to them and told them my case wasnt until a certain time in court which was a couple hours after it so they couldnt talk to me and provide info to make me look worse with nobody there for me. Asked question while in court he told me to shut up and repeat everything he told me to say and kept telling me I’ll get 35 years if I dont agree. No nude images was sent,never asked for any,1 comment in general to the woman I was talking to. No other sex talk. Told detectives emails they showed me I didnt see before but they told me to sign each page anyways. It’s all a scam to make easy money. I guess building a new court house.maybe one day we the people will get fair treatment and the government will be held accountable for it’s illegal actions. And adult only sex site looking for older women.

      Agree with the easy money thing – my husband is a seriously disabled person who has a lot of trouble walking fromm artery surgeries and congestive heart failure – when we learned of the requirement to register due to an old case it was news to us – will not go into details but a case where it was all about getting mitts on money – he had passed a lie detector test still found guilty did probation and thought that was the end of it all – its all disgusting the extrees people will go to for money. Since he has been required to register I hear the reports of how he is badgered with the same questions over and over again – he has over heard conversations where apparantly persons working for sex offender registry unit are getting bonuses if they find person not where they are supposed to be – I don’t go anymore because gave up car and have had a lot of trouble with theives trying to get into financial accounts where we are stuck living so one of us has to be home – nothig doe about the theives and actually one time I called police about wallet disappeared I got a copy of the police report and it was not accurate information recorded – since I got rid of the car he is badgered about that – I get constant phone calls re: insurance on my car and after the things I read considered that it might be the unit trying an entrapment – anyway, when my husband once asked them why they kept badgerig hi with same questions the response he got was that they wanted “them” all in jail. Pathetic with the stories I have heard from others about underage girls that became involved with older men and then when the men wanted to break up with them they cried wolf to make the man’s life miserable – know of another one in trouble with law because his co-habiter accused him of holding her prisoner but he worked regularly and she could have left anytime she wanted to when he was working – she didn’t have a problem taking trash to the dumpster – the real issue was that he had gotten a raise and he was trying to save money but she couldn’t get hi to give her what she wanted – Marion County is full of such people . On another note – since the same prison they stick arrested people in is the available emergency shelter for offenders for Hurricanes, etc. I had called to see what accommadations they would make for a man on a multitude of medications for the heart failure and diabetes and on restricted diet – told have to bring his own food – get that one – when my primary duty as wife has been to make sure he eats what he can – not easy stuck living in a motel – irony being as an older woman with my own disabilities physically with walking I have to constantly be worried about my safety with all the hyped up on drug types I am surrounded by – think the crainess all needs to be exposed

    I think we should ALL together file a Class Action Lawsuit against the sponsor to this stings, which I believe it is the State.

    Unless we ALL get together on this to expose the corruption, nothing is going to get done.

      The stings are there for one reason. Too make the revenue collection easy for states to fund their draconian methods. The registry is easy picking for law enforcement and unscrupulous strollers to threaten or harm those of us on that registry. Dont believe the hype that registration is not punishment. It certainly is.

      Want a way to de fund these operations do you?

      Step one:
      Contact your county courthouse and do a records search for anyone arrested for either soliciting a child for sex online or traveling to meet a child after solicitation, or both.

      Step two:
      Go through said records (they will be arrest reports) to check for duplicates and then sort out those arrested as the result of a sting. There will be a few left over that were NOT sting related. Take note of where initial contact was first made, online vs offline for the non sting arrests.

      Note that the Florida Statute for traveling wasn’t codified until ’07. In my research I found an overwhelming number of arrests occurred after an ICAC was introduced to that county. Feel like comparing notes? I’ll be more than happy to assist.

      The numbers should speak for themselves.

      I was trapped during an online sting, there was no underage victim but a PO that got his kicks by pretending to be an underage girl. I received phone calls from unknown numbers to meet. They would call and not say anything. I accepted the plea just to make it all end. but it never did, did it?

    I was also entrapped by a sting in 06 and was made an example of from the state. Out of 34 people arrested I was one of the few that went to prison. My mistake was hiring a lawyer that wasn’t part of the good ole boys club in fort Meyers. I lost everything after prison, my children, my family, everything I owned was gone. To this day 15 years later I am still suffering, no one will hire me, and I feel stuck in this state. The prison was a nightmare. Being abused by the DOC police was worse than the abuse I took from other inmates. They kept moving me from camp to camp until finally, I was able to be placed at a protective custody camp. The whole ordeal was a nightmare. Not only was I entrapped but since this was done by a vigilante group and dateline NBC, it was run over and over again especially during my trial. I ran out of money during my appeal and suffered. since being released I have held few jobs until they found out about my prison stay by the vigilante group and subsequently fired. If there was a way to go after the state and all of the money makers in the prison sting industry, count me in.

    This Comment is directed to you and others!

    It took me 8 years to obtain my real evidence and transcripts which for me was after the fact. In Polk County, Elmer Fudd was and has been able to manipulate the System by doing what is called ‘overlays’ in which he uses a ‘Template’ of sorts to filter information and uses that to Manufacture Lies and Crimes on the defendant. It took years and over $10K in legal fees (which was very reasonable, considering) to sue Verizon in order to obtain the REAL INFORMATION; and then at the last minute, WE GOT THE INFO, before going to TRIAL!…go figure!

    In my particular case in Polk County, as well as OTHER HUNDREDS of Innocent Men, were PUT in the Same Template; their names were changed; the dates and times* were changed’ The same ‘DIALOGUEs were cut and pasted…. What screwed them was ‘THEY’ forgot about Day Light Savings time* etc when the sheriff’s deputy duplicated the template….There is the KICKER…..WE have waited years from a response from good ole grady, ELMER FUDD, and THEY WILL NOT RESPOND……So that is the BIG Problem…To really find a Flori-DUH based Law firm to have the balls to challenge ‘THIS SATAN’, well good luck on that as NONE to date will accept this challenge!

    Perhaps, Ms Gail and others can find the right group of legal eagles to fight this, as this case will basically overturn many political graves

      The contents of the record doesn’t concern me. The end result does. Those few who have been arrested for either of those crimes not related to a ICAC sponsored sting and those who were.
      There was a time when the media was paid to and gleefully posted full listings of those arrested. Is that still a thing? I will not watch local “news”.
      So again, those arrested via ICAC sting ops vs those who were not.
      Any information beyond that isn’t necessary.

    Here is the deal and it is simple,

    Anything that makes the State money is “legal”, and let me explain.

    I was a contractor for the following county courthouses in Florida, Volusia, Polk, Sarasota, Broward, Brevard, Lake, and Dade.

    My contract work was to install the necessary wiring inside courtrooms and the building itself so that they could place microphones everywere. So if you think that you and your attorney can have “priviledged” conversations, guess what, most of your conversations are also recored inside the building without your knowledge.

    I did this contract work for about 20 years, and I since I had the priviledge of being a trusted contractor I got to learn a fuck load of corruption behind that bench and how they made money off of people.

    I got tired and also scared of their latests scams in 2011. So I quit and went off to start my own company. And guess what. With my new company the State DBPS began threatening me and forced me to close my business, immediately after that they tracked me and set me up with this nonsence.

    I WILL EXPOSE THEM eventually, but trust when I say that they will look for me.

    And since nobody wants to help us, well, when I receive asylum from another country and begin exposing this and many other crimes commited against citizens don’t go crying.

    By the way, once they learned that I was an excontractor and what I used to do for the crooked State, they released me, and canceled the 5 years of probation with the condition that I would leave the State of Florida and never return.

    Yes you heard that correct, they canceled half of my sentence because they learned that I was pissed of and might expose them, so they tried to make me happy.

    Well screw the State, as soon as the asylum country reviews my request, gives me a change of name, and issues the passport I am gone.

    So why doesn’t the Florida Action Committee organize a group lawsuit against the state for this exact crime against its citizens???

    Right here in this chat there’s at least 10 people that would sign up! I’m sure we can find many many more!

    What’s your answer Florida Action Committee? You have the knowledge and resources, so what Action are you taking???

      Jay, What do you propose the lawsuit would seek and under what legal theory?
      You can’t likely file on behalf of the people who were convicted after being entrapped because they either accepted a plea or were found guilty. I suppose someone who fought their case and won would have standing to bring a lawsuit. Perhaps a malicious prosecution case.

      the only way to do so would be to file an injunction in federal court to stop illegal stings at least temporarily given the overwhelming evidence showing they’re illegal. I know exactly how it could be done but making it happen is a different story.

          finding an attorney or firm willing to tackle such a case. I literally have enough documents to support the effort but unless someone is well connected with a notable attorney, legal fees are not cheap.

          also, we were so close to exposing this crap nationally when Noah Pransky called out these stings on local news in Tampa. I worked with him religiously trying to get him the information he needed to proceed and he did an excellent job…….but the story never took off as we had hoped by alerting legislators, the DOJ etc. We were wanting to force the DOJ to investigate into things. Many of us filed numerous complaints with the DOJ to no avail. So much work had been done to get us to that point only to hit another brick wall. Is there a way to still find success? Yes, as i stated earlier, it would be in the form of injunctive relief from a federal court ordering the DOJ to look into things. Once that happens then things could change.

    Florida does not follow the law.
    My son was caught up in a Florida child sex sting in 2011. We lost at trial. Our attorney had never done a sex sting case, and we were not knowledgeable about the law. It has been many years of fighting, and we learned a lot. We found a good lawyer who has tried to clean up the mess. I have learned from what I can see is that the police are not the only ones who are corrupt but the courts are too. My son’s case is clearly entrapment as a matter of law and the judge just turned his head and pushed it on to trial or else take two felony pleas.
    When the ICAC officer took the stand (under oath) and was asked by the prosecutor, “are the police allowed to bend and break the rules and even violate the laws of the state of Florida to catch a criminal” the officer answered “yes”. My son was no criminal. The officer was the aggressor and pushed my son into going. My son said, “Maybe tomorrow”. The ICAC officer said, “Oh well you sux!!! Why tomorrow”. The ICAC officer was the initiator, willing participant, aggressor, or provoker of the incident. We are still fighting to this day. However, Florida will not listen. Although it is hard, I am now speaking out.

      well at least the 2nd DCA did the right thing with Deware. It’s sad it even had to come to an appeal as in my case. One,among numerousproblem is that trial court judges are elected officials who don’t want to be in the news for letting someone off that was arrested in a sting operation..
