Bill containing very concerning changes to registry filed – SB 1932
Yesterday, Senator Ed Hooper filed SB 1932, which is a 100+ page bill making significant changes to the registry. We have not gone through the bill yet, but one glaring and very concerning change is that the State makes it more difficult to petition for removal and now requires that FDLE be noticed on every petition and FDLE plus the State Attorney have an opportunity to oppose.
More to come, but in the interest of getting this to you as quickly as possible, please read through it yourself below.
It’s an election year folks. Did we expect anything less from our politicians with financial interests in keeping the registry as full as possible?
Its almost impossible to petition to get removed now if you add FDLE into the mix it will be totally impossible. Their whole organization is buit around us staying in their control why would they ever let any of us off the list????

I ran out of grocery stores so now I travel from Florida to Alaska to shop LOL . Just kidding, but, this is complete and utter non-sense. One more nail in the coffin for a judge to say “This is punitive in nature”. Why, because on probation we also had to keep a log of everywhere we went.
Most of us who come on here have done our time decades ago. Have not not been under supervision since 2003. My crime was in 1991. Punitive in nature as it directly correlates and mirrors probation in structure.
Lol from Floriduh to Alaska… Yes, the Registry does mirror probation. It’s just less supervision. For me the registry is more punitive than probation. Atleast when I was on probation and had a technical violation, my probation was reinstated and was out of jail in about 2 weeks. A technical violation of the registry is 1-5 yrs. I believe it’s 1 yrs minimum mandatory now?

Wouldn’t the sheriff’s office be considered a frequent place registrants go to more than twice a year? Wonder how placing the sheriff’s office would be considered if it were on the registry and for life. Does anyone read things before a bill is submitted or is it ugh whatever sticks let them have it.

I’ve read the whole thing and I don’t really get what’s that concerning about the bill. The only difference with removal is that now FDLE gets notified, but judges will expect that both they and the state attorney will always object, just like they always object for early termination of probation. That does not mean that judges always deny. In fact, when it is the policy of FDLE and/or the state attorney to automatically object, it makes the objection almost meaningless.
Yes, the definition of a day as “any part of a day” is problematic and will probably get fixed somewhere along the line. Even if it doesn’t, assuming that we have to register every place we visit for 2 minutes a day 3 or more times a year is an absurd result and clearly not the intent of the bill. Finally, the bill would allow us to register vehicles online. So overall, I don’t see why this is “very concerning.” Someone will have to explain that to me.
FDLE gives the state a second bite at the apple for removals. They have consistently been ruthless in opposing these when they lack standing. If they have standing, they will get a seat at the table. Separately, the “any part of a day” is HORRIBLE. You cannot assume it is “clearly not the intent of the bill” because (a) the legislative intent is already devoid of any factual basis, (b) all it takes is one deputy to interpret it differently to arrest someone and one judge to agree, and (c) this “part of a day” issue was raised, ad nauseum, to the state many times before and they are fully aware of the concern. If they wanted to address it, it would have been worded differently.
Many lawmakers trust FDLE. How do we make the case to them that FDLE’s involvement here is unreasonable?

Yes, even though my views on this may differ from FAC’s, I will do all within my power, including donating funds and writing comment cards and letters and emails, to try to block it. I understand the concept that we can’t yield one inch of ground without a fight. Otherwise, they will take a mile and a half every time.

Call me stupid, but I am totally befuddled by these hundreds of convoluted lines. There is reference after reference to other sections of Florida code. Is it really considered “fair notice” if one must research all those legal threads in order to understand requirements? I have never seen such incomprehensible gibberish in a bill. Of course, this is the first time I’ve attempted to read a Florida bill.
If Sen. Hooper has enough time to dive into all those statutes, why does he not have enough time to read reports and research about sex offender recidivism and danger to find the truth?

How can the ex post facto law that is in court right now play into this? Obviously the most concerning is the removal off registry. I can see this bill being changed 7 ways from Sunday before it makes it to final vote but isn’t the ex post facto law if we win supposed to protect us from bills like this?

The Registry Nazis are getting scared they will lose their funding and jobs because of all the wins that the courts are issuing. But just like in Michigan, the Gestapo finds loopholes to go around the rulings. In other words they have ZERO respect for the judges wishes. I’m talking about those with loved ones outside of Florida. We all have a choice to make stay and fight or leave and fight. My parents and I were the other family living in Florida, so I choose to leave and fight. Don’t have to worry about to much backlash from out of state. I rather be kissed on then pissed on. I don’t know about any other countries but a while back I heard that Indiana is the least restrictive state concerning the registry. Now, with this new federal involvement on the registry I have no clue of which state is least restrictive. I also though about leaving the country but I can’t see myself living so far from my family. So it’s stay and fight for me atm.

Most European/eastern European countries for now don’t care about RSO’s. So if your retired and have income coming in or if you can work mobile you can have a new life without restrictions like the way i feel when i vacation in places like that and it is pretty easy to get a visa to live there if you find the right lawyer

Why don’t you begin educating the public by submitting press releases to print, cable and television media across the state using empirical research data to make your voices heard via educated voters.
When I was one TikTok there was a creator that is a therapist and work with registered people and formerly in a prison. She advocates and I would share facts with people who made negative comments. There is no shortage of data to use. The problem is people in general put feelings over facts. Laws should be fact based and not based on feelings. But that’s not the world we live in. We can all share with others online or in person. Doing mail campaigns or emailing politicians. We can all do something.

You can NOT argue with someone that will never change their minds on this topic no matter how credible the evidence you present to them. Hate and resentment overrides their executive functioning. All you will ever get from the proponents of the registry is: “They’re on there for a reason” and “I only care about the victims.” So, we’re up against militant intransigence here.
Write your congressman? Ha! Have fun with that. They’re in on it! It’s their reliance on this registry hate and division that keeps them in office.
I’m far from the most optimistic person in general, but especially when it comes to this topic. I said feelings because this subject stirs up intense feelings and emotions. Not everyone that is against us hates us. Several people think the registry works because they can simply see all the dots on a map. Some people’s mind will change when presented with the right data. Everyone believes in protecting children. Some people also think the government wastes money on programs that don’t work. Other feel rights are important and shouldn’t be infringed upon. So, we either advocate, and educate or just give up and go play in traffic.
Press releases are great, but not for this. We need to make sure this bill dies in committee.

Never fails, getting close to getting off this nightmare and this crops up. Hopefully it doesn’t pass, i wish a newspaper would print everything we have to do to stay legal while being an RSO, i think anyone who saw the 3 white pages of rules and regulations we have to go through daily, in order to stay on the outside of the fence, would deter anyone from making an unwise decision.

It’s another ploy to find ways to throw us all back in jail. That’s their whole intent, didn’t serve a life sentence? Well we can fix that, we hear by create x law and x law and x law to make it simply easy to violate, so we can send you back to incarceration!
Part of what successfully killed these provisions last time was popular backlash by FAC members. Legislators were surprised to learn that these laws are NOT as popular as they used to be. In committee, our volunteer presented 170 of our appearance waivers expressing opposition, as opposed to like ZERO members of the public speaking in support.
This turned out to be more impactful than, say, studies on recidivism rates, which many lawmakers already have been made aware of, even if they don’t always admit it.

As for legislators being aware of the low sexual recidivism rates (which you are probably correct in saying), this bill still contains lines 197-202: “Sexual offenders are extremely likely to use physical violence and to repeat their offenses, and most sexual offenders commit many offenses, have many more victims than are ever reported,……” Where is his research to back up this statement?
This also occurs in statute 775.21. I sent every legislator back in 2019 the findings from the DOJ’s recidivism report in May of 2019. Too many political leaders say whatever they want to say and I guess the public takes it as fact.
Just because lawmakers insert that preamble, doesn’t mean they believe it.
Some are aware of the recidivism stats but disregard them due to low rates of reporting.

I spent most of today, up to now, reading this mess. Instead of keeping the existing framework of 775.21 and 943.0435, Hooper decided to copy and paste large swaths of the two laws and underline everything as if it was new, with no strikeouts.
If I am understanding the bill correctly, there will be no way to get off the registry if it passes as is. That is the most concerning language to me. Read lines 1706-1772, grab a refreshment and have a seat, then read lines 1773-1777. Lines 1706-1772 are what 943.0435 contains now, but under a new section:
(11) RELIEF FROM REGISTRATION.—
The problem lies with lines 1773-1777:
“5. To qualify for removal under this paragraph, the sexual offender must not only establish the requisite criteria to be considered for removal, but also that they do not meet the criteria for registration under any other sub-subparagraph under subparagraph (1)(h)1.”
Well, those subparagraphs enumerate all offenses which got you on the registry in the first place. They run from line 1157 to 1245. This makes no sense at all.
Other items of concern, as many have pointed out, include the “any part of a day” BS, and also the international travel notification removes the “5 days or more” language. So I guess it’s 1 day or more now.
The only upside in this poorly-written, confusing bill is the ability to make vehicle changes, legal name changes [maybe?], and renew drivers license online. There is also ambiguous wording on whether changes to permanent, temporary and transient residence could be made online (lines 1473-1483):
“(6) ESTABLISHING A RESIDENCE WITHIN THIS STATE AFTER INITIAL REGISTRATION.—
(a) A sexual offender shall report in person to a driver license office, or through an authorized alternate method as provided by the Department of Highway Safety and Motor Vehicles, and is subject to the requirements specified in subsection (4):
Each time a sexual offender’s driver license or identification card is subject to renewal; and
Without regard to the status of the offender’s driver license or identification card, within 48 hours after any change in the offender’s permanent, temporary, or transient residence.”

The “Somewhat” good news is, several Florida judges have constantly ruled that these new laws and amendments cannot be applied retroactively. Several have gotten off after 20 years instead of 25 due that one particle judge stating “You cannot change the time line”.
That is our little bit of hope.

So a ‘Person Forced to Register’ who is on Flori-Duh’s Hit List, moves from Flori-Duh and is Subsequently Removed their State Jurisdiction’s Hit List, Is still on the Flori-Duh Hit List and still must register when visiting Flori-Duh-even that person has been removed from their Resident Jurisdiction? I am sure though that some bigger metro areas may or may not do this but hick town sheriff’s like Wanye Ivy, Chitwood and other Sheriff’s are sure to be on you like white on rice. But like I said, that was one person’s experience. They made sure he was staying at that location, made sure the car he was in was registered etc.

Most likely, they do not know. But God help you if you get caught. It is like a game of Russian roulette, you can pull the trigger and spin the barrel numerous times and not get hurt. Then that one time, things go horribly wrong. And the sad thing is, in Florida at least, judges do accept the excuse that you didn’t know, and they don’t care either.

So I guess nothing changes for me as I’m no longer a Florida resident, yet I’ll forever be a threat to Florida communities for life and death even when my time on the registry expires in my state. Even if I send FDLE proof that I should be removed I’m still SOL.
