Arrest made in murder of Nebraska person required to register as sex offender
Omaha police announced the arrest of James Fairbanks, who was arrested on suspicion of criminal homicide in the death of 64-year-old Mattieo Condoluci. Condoluci was found shot to death in his home this past weekend.
Police arrested Fairbanks after he was linked to an an anonymous email sent to the media. The email claimed Condoluci was shot because he was listed on Nebraska’s sex offender registry.
So again how is the registry protecting anything. It’s a shaming list, hit list, and list of person to set up to fill jails beds. All for $$$$ and TV time and help so they don’t have to the real work these days.
NOTHING to see here folks. Move along, this is NOT, I repeat, NOT punishment. Just a bump in the road in your life which should go to remind you of your transgressions which We the people will NEVER, EVER forgive you for.
That is all, please resume normal activities at this time.
For Cherokee Jack-
I am hoping your response to this is an attempt at facetious humor in response to the man who once kicked the victim out of his house.
It was not at all humor. You must not read many of my comments.
I was being sarcastic at how being on the registry supposedly is not #1 Punishment and #2 supposedly does not cause us any undo harm.
law enforcement will blame the murdered man saying if he hadn’t committed a crime in the first place he wouldn’t be in the mess he got himself into.
It is open season on those of us on the registry. I once listed on here 13 different police reports of crimes against me on my own property and nothing was ever done.
We are not allowed to own a gun or protect ourselves in our own home. We are sitting ducks just waiting to be picked off with directions to our houses right there on the registry.
I would like to point out that, as I am sure you know, you are not allowed to own a firearm. While that is somewhat synonymous with gun, it is not the say. There are guns that are not classified as firearms you are allowed to own. Cross and Compound Bow ownership is also allowed. I would recommend everyone own and become proficient with at least one of them.
Seeing stuff like this drives me crazy that they don’t see the registry as punishment. Yesterday my local address verification detective came by and we were discussing the registry. He even said it’s all political and it does nothing to prevent future crimes. He brought up the Donald smith case how the day before he was checked on and verified and then the commits that horrible crime. We also discussed how everyone should not be labeled the same, he seemed to think changes were coming. He said they can’t continue to justify the cost of the registry when it does nothing. He did say there are people with deep pockets that back it up tho.We will see!!
Vigilante. And a dumb one at that.
Who does he think he is? Batman? Superman? He sends an email with basically a confession. He mustve thought the mayor was going to give him the key to the city and erect a statue for him.
Dumbass!
More in-depth, including reaction from his daughter, reaction from mother of one of his victims, and the role played by Facebook:

Just think what would have happened if the registered person would have fought back like I would have done and the role was reversed and the attacker was killed by the registrant ?
They most likely would not have ruled it self defense and sent him away for life. Having said that, this guy probably has no connection to the original case and even so, now he has hopefully destroyed his own life, and no less his families too.
FYI – There was a Facebook page targeting this guy, and the woman who runs the Facebook page was the mother of the alleged victim from the 1994 arrest.
Also, the Omaha World-Herald reports the killer had seen the Facebook page run by this woman. If this vigilante KILLER was that passionate about this as he claims, then there’s no way these two individuals did not communicate with each other. When I see a news story or blog of great interest to me, I reach out to that person. There’s no Laura Smith did not know the killer.
There are already THREE GoFundMe fundraisers for the killer.
Another thing, I emailed a certain reporter about my concerns, but within hours, the aforementioned FB group somehow found out about my contact, leading me to believe this reporter tipped this person off, though I can’t prove it 100%.
There is something far deeper about this case than anyone realizes.
Dear Darek Logue-
I salute your activist credentials and all the sturm and drang you’ve probably weathered to date, and I do hope you can take a lot of satisfaction in the difference you’re making for all of us on the registry with all the efforts you’ve made to date. Stay well and safe!
I knew him very well at one low point in my life. This person was pure evil and the world is a better place today because of this other mans’ action. I had him in my home with my wife and kids for dinner and caught him in a lie. I went and looked him up online and found out he was a multiple time sex offender. I called him after he left my home and told to never come around me again or something bad would happen. He was trying to persuade me to let my oldest son who has mental issues to come live with him. I would never have let my son live with him but he was trying to groom me. He used to bring my kids Barbies and toy cars that he would get to give out to homeless families children. He wanted me to donate my money to build him a church for him to run his fake charity out of.
So sorry that you experienced this, Relieved. Please keep in mind that this behavior is in no way representative of the vast majority of people required to register.
Nothing justifies his murder, of course. There could have been many other solutions, and registration was obviously was not it.
i question this particular post. Who is this person and why does she sound like someone from the online group? This post should be double-checked.
We look at it as an opportunity to educate.
We’re likely to but heads over this but I believe some people simply cannot be reasoned with. I immediately think of this certain FL state senator who wished critics “would speak directly to me so I can show them the amazing work we are doing on behalf of children.” I think we remembered what happened after that.
There has been an outpouring of support for the murder and despite the man’s past, murder is murder and it is the principle of using the registry as a weapon should be challenged. But I’d say that this website, which offers support for registrants, is not a proper battle ground. Besides, I’m pretty sure this person was a one-off poster anyways, and will likely never read it, since his/ her intent was to stir the pot and nothing more.
Murder is murder. Sex offending is sex offending.
I expect a prosecutor to do their job but when one like I had “CHEATS and LIES” to get a win and hangs out after work with the judge who sentenced me in front of her ( Known to ALL in legal community ) that is cause for losing her legal license.
Although I wished ants to crawl out of her eyeballs for playing so dirty two things. #1 I would never wish her dead, and #2 If I was a victim of a crime, I would want someone like that in my case, which kind of makes me a hypocrite.
Also funny how we are not allowed on over 100 sites and counting and yet those people are ALL welcome to come onto to F.A.C and say things against us. Many that are very disturbing, but 5% of my post on here are never published.
Not from any group I dont know any of you on this site. I didn’t know what this site was when I posted this comment. I now realize what this site is about and I agree that no one should have to live in fear for something that was done in the past. But Mattieo was the scum of the earth and was a predator. The police here asked me to testify against him but I declined out of fear from Mattieo. Mattieo was a hells angel with tattoos of murder on his arm. He told me he murdered a man in his past. So all of you who are defending this person you should know who you are defending (a murderer). He wasnt a good person and he got what he deserved. The sun will shine and no one will shed a tear for this POS.
Relieved. I hope you will sign up to receive our weekly updates and continue being a part of this forum. I always welcome new and opposing points of view.
I find it interesting the people that go online and think that they can discern a person’s character by their criminal actions that are decades old. How much of the persons kindness and concern for others was out of learning from their mistakes and trying to make amends. Using the registry to justify any action against another person rather it is physical, mental or emotional abuse. Should you be judged as a human being by your past criminal actions.
Personally, I completely believe that “people” who look at the Registries and think about harming a person listed on them or any “people” who cheer about it are low I.Q., low self-esteem cretins. I really do believe that. I don’t think moral, intelligent, good people do that or consider anyone who does a decent person even, let alone a “hero”. I think “people” who would support such things are the dregs of society and that a much higher than average percentage of them are criminals and have harmed other people. It wouldn’t surprise me if a lot of them have been active criminals their entire lives. I would love to see a study that shows their demographics. I bet I’m right.
Regardless if you are in the military or the police department, anyone who takes a life ( even if justified ) and it doesn’t bother them that they had to take a life, they have some issues.
I thank God every day that I never had to kill anyone when I was on the force, although most of the people were already dead since I worked in homicide. ( Yeah that took a toll on my mental health too )
AND add to that that the ,majority of those killing people on the offender registry have ZERO connections to the person they killed. We could “Sort” of understand if it was the original victim lashing out but that is rarely the case. Even their families are usually not the ones doing it but complete stranger vigilantes.
Since posting news links won’t get published, Google “Ex-wife: Omaha man arrested in killing of registered sex offender fearful man would offend again” at the Omaha World Herald.
The World-Herald is doing all they can to paint the picture of this killer as a sympathetic person. People are trying to excuse his actions.
“Several people on social media lauded Fairbanks, many calling him a hero and saying he deserved a medal instead of being arrested.
Others said they planned to give money to his jail commissary account or a fund to hire an attorney.”
They made no mention about anyone concerned about vigilantism except the prosecutor.
PS: The comment by one certain person claiming to have known the guy who was murdered doesn’t smell right to me. It sounds an awful lot like comments posted on the vigilante blog.
One last thing and I’m done here —
It is important that people go to GoFundMe and report EVERY fundraiser for this killer. Already, I’ve reported at least 8 different fundraisers started for this killer.
The vigilante group involved in this man’s murder is looking to start a GoFundMe for him as well. GoFundMe has allowed many vigilante fundraisers in the past. With enough public concern, we can change their policy on allowing these fundraisers to happen.
Although I hate what this guy did, and NOT sticking up for him in any way, not sure it is illegal for someone to raise money for someone’s legal defense. In the same way when we were arrested for what we did ( or maybe didn’t do ), if someone wanted to raise money for us, someone out there would be pissed about it, and try and stop it.
Most of us might be thinking that we hope the killer rots in hell. I am sure there have been people who have thought that about me, I know the prosecutor did when I won an appeal. She made that clear to the judge. AND I have never killed anyone. Heck I cry when someone kills a squirrel lol
I am reminded of the recent killing of the black man in Georgia by the retired detective and his son. The way I viewed that was it didn’t matter if the man had robbed every house on that street. It did not give those two men the right to grab guns, hunt him down in the street, and engage with him, at which point he was shot multiple times and killed. That is what the police is for.
Same thing here. This person killed someone. Doesn’t matter if he was the biggest scumbag on the planet. Doesn’t matter if he was a serial predator. It is not the job of a vigilante to dispense justice. That is the job of the justice department.
For Cherokee Jack-
You’re right, I don’t get on here enough to read everything by everybody, but once in a while, some ignorant crank will offer a rank. I didn’t necessarily misinterpret your comment, I just wanted to make sure…
We can joke about this stuff amongst ourselves, but it’s always thru tears and sadness at criminally monstrous government overreach due to pandering legislators trying to hold onto their power and outrageous expense accounts. We are the political third rail in legislatures all over the land in both state and federal governments.
I find it not at all curious that when I was a lad there were only two paramilitary groups in the U.S. who were thought to have aspirations to overthrow the government. Both were considered jokes from that standpoint. NOW…there are over 1200 such groups led by former Navy seals or Army Rangers who have retired who train almost every weekend to take over local power centers, radio and tv stations, etc. and coordinate with others all around the nation. These are people who are sick and tired of the Washington bullshit promulgated by both political parties. We are not that far from another civil war judging from the intransigence on both sides of the Congressional aisle and the constancy of increasing rancor that results. Every politician seems to have taken a page out Senator Joe McCarthy’s playbook, with former sex offenders and registrants playing the part of the Communists who weren’t REALLY Communists at all! I find it really strange that there are more culpable “sex offenders” in high political office than there are on the Registry and have been for some time-going all the way back to Wilber and Fanny Fox.
For Derek Logue-
As usual Derek is out in front with practical activism advice for all of us and leading by his example. How about some “go-fund-me” accounts for registrants to fund a coalition dream-team of rock star lawyers to fight for us in the courts before those courts come under even more political influence.
We do have a donations page to fund litigation brought by rock star lawyers (who are not taking fees) and rock star experts.
PLEASE donate to our legal fund!
It is honestly better to just send funds directly to the various organizations you feel are helping the cause. If you are sending large amounts of monry, write a check/ MO. Paypal, GoFundMe, and all the other online services take a big cut out of the donation. If you send $100, both Paypal and GoFundme will take 2.9% plus 30 cents transaction fee, so $3.20 of the $100 donation goes to the service.
GoFundMe DOES NOT advertise your fundraiser. Sure, it is on their website and all and you can search for them. But I saw only minimum advantage to trying to raise funds on that platform. I raised $265 earlier this year from GoFundMe to keep the website going (After fees, closer to $250) over a two month period, whereas I raised more than that off the site.
But on the upside, GoFundMe does offer a level of security for the funds that may compel folks to donate through that service. Still, if you were going to donate, say $1000 to FAC’s legal fund, you’d likely do them better by sending a check in the mail.
That’s just my experience on this.
The problem with arguing in the manner as follows is that it will not work. I commented on one of these facebook groups as follows.
Like most Americans I believe children should be protected. For that reason I wish to be killed. The only caveat is that I wish for my organs to be donated. There are 180,000 Americans waiting for kidneys to be donated. A lower, but still significant, need hearts, livers, and pancreases. I am assuming they are “good” people like you.
My name is Richard M. Baine and you can look me up on the NJ sex offender database. Feel free to visit my website evilsexoffender.com and read about me. Determine if I should live or die.
For FAC-
I always do. I have been dong it through NARSOL and their Vivante Espero fund as well as contributing further to remain a member and get the postings.
I picked up my charge in Florida, a non-violent, no contact one that was actually an illegal sting by the Postal Inspector and currently have an Error Coram Nobis down there in play. But I am strapped for funds, especially during the Pandemic when everything is shut down. But I would support any fund whose primary purpose is to get rid of the Online registries. I don’t why it is that all legislatures both state and federal continually pass unconstitutional laws that are then SUPPORTED by the COURTS!! HOW IS THAT POSSIBLE!?
For Derek-
I wish I did have bundles of cash to donate not only to NARSOL but to all the state subsidiaries of the organization. But I don’t. I have donated several times to Vivante Espero and lived on rice and beans for several months because of it. I have an error Coram Nobis filing in Florida right now for an absolutely illegal arrest and conviction. It has all but destroyed my life and family. What I still cannot understand is how PLAIN English in which federal, state, and local statutes, laws and regulations can be deliberately misinterpreted by politically infected courts to achieve the outcomes they want. I have seen few judges, and especially the ones who have denied all my pro-se attempts to find justice, and a few good lawyerly attempts as well, that are willing to really stand up for Constitutional standards which are constantly trashed by both federal and state legislators as they make their often rotten and corrupted “sausage”. Walk into any hall of Congress-CAN’T you SMELL IT!?. They have names like Adam’s law, Megan’s law, Jessica’s law, and half a dozen others just like it. SORNA and state derivations of it positively REEK of unconstitutionality!
