Alliance for Constitutional Sex Offense Laws Sticks Up for Parents

Kudos to California Attorneys, Janice Bellucci and Dennis Riordan, and the Alliance for Constitutional Sex Offense Laws for sticking up for the rights of parents.

The attorneys filed a lawsuit against the Ventura School District, on behalf of a parent of a second grader who is prevented from taking his child to and from school and attending her school events (such as parent-teacher conferences, plays and graduations). The parent, in this case, is on California’s sex offender registry for an offense that took place twenty-seven years ago!

The law, which was allegedly intended to protect children, actually puts this child in harms way because the father must deliver his 7-year-old to the edge of the buffer and have her navigate a public thoroughfare on her own to make it to school and then leave school unaccompanied to find her way back through the thoroughfare to meet up with her data at the edge of the buffer.

The law is absurd not only because of the consequences of it’s application on parents and, more importantly, their children, but because it’s not based on any evidence that it’s even effective. That’s from a logical perspective…

From a legal perspective; the suit argues that the law violates the due process clauses of the State and Federal Constitutions, which “protect the fundamental right of association between parents and children, which includes the right of parents to participate in and to direct the education of their children”

This will be the third lawsuit filed in California (the others against the Grossmont Union High School District and the Fontana Unified School District) concerning the same issue. FAC sends it’s gratitude to Janice and Dennis for keeping up the good fight and  our thoughts and prayers to the plaintiffs – who only want to be parents to their children!
