Advocates call for an end to the public sex offender registry
OMAHA, Neb. (FOX 42 KPTM) — A shooting in North Omaha has sparked concerns over the state sex offender registry. Following the death of Mattieo Condoluci, members of the National Association of Rational Sexual Offense Laws (NARSOL) are calling for the state to remove the public state sex offender registry.
“If he was not on the registry I have no doubt he would be alive,” NARSOL Vice Chair Robin Vander Wall said.
Vander Wall said the current system requiring sex offenders to register and make their address public is not effective in keeping the community safe.
“The statistical research and the data now that has been done over the last decade just demonstrates almost uniformly that they aren’t doing any good. They aren’t really accomplishing any useful policy purpose. They are kind of feel good laws, they make people feel safe, but at the end of the day they are not really safe,” Vander Wall said.
Local sheriff’s departments are responsible for doing compliance checks on people listed on the state sex offender registry. Fox 42 reached out to the Douglas County Sheriff’s Department, but no one returned the request for comment.
In Nebraska the online sex offenders registry lists an offenders name, current address, the crime committed and a photo. According to Fairbank’s ex-wife, Fairbanks killed Condoluci after learning he was a sex offender.
Don’t expect LE to respond. They know they are in the wrong and if they were not afraid to speak the truth they would confirm that a public registry is a waste of manpower and money…but then it takes courage to admit that.
The place that I’ve called home for most of my life needs a quick reality check. Nebraska’s Registry is a dismal failure. Back around 2013 the Nebraska legislators asked for a study on the registry from the University of Nebraska at Omaha. Surprise, surprise the study revealed everything that experts warned about and could comprehend: it doesn’t work!! Nebraska legislators have blood on their hands. Now is the time for them to grow a set and a spine by doing the right thing. Standing up for all Nebraskans constitutional rights including those on the registry and their families. Allow healing for both the victim( if there was one) and the person that committed a crime resulting in safer communities!!
Brandon – can you dig up a copy of that study and share it?
Yes I can just give me time to reach out to her regarding the study. I know she did a 3 part series on registered citizens with Ketv7 news back in 2017 that I found on the web. Hopefully she’ll get back to me soon. I had to do something because this hits close to home and wrong on so many levels; so why not use my connections that I have in Omaha and the state of Nebraska to my advantage.
This is further proof that the public not only gets no benefit from the Registry but cannot be trusted with sensitive information of Registrants. Misusing this information has been documented over the years from scams, employment loss, harassments, and more violent deaths.
James Fairbanks would not have become a murderer if he didn’t have access to Mattieo’s sensitive information. Furthermore Fairbanks has stopped nothing to prevent future sexual assaults which is perpetrated by 95% first time offenders NOT on the Registry.
The outcome has not changed. Just another tragedy on top of a heap of failures and lies fraught by the Registry.
Should I be surprised that the gist of the story was about the registry being detrimental in its public form yet fox news made it a point to include the man’s convictions?
No. I am not.
Here’s the link: http://news.legislature.ne.gov/dist20/files/2013/08/NE_sex_offender_recidivism.pdf. I couldn’t find it earlier but after snooping around I found it.
Here’s an idea that could possibly be used (by a professional attorney) to argue the registry; The registry was made because of 1, maybe 2 instances of child abduction/murder: Jason Wetterling and Megan Kanka. TWO children out of how many millions? And the powers that be love to use the tag line “if it saves just 1 child”. Ok, so we have about 7 or 8 (maybe more) registrant murders since the registry was enacted. Perhaps it’s time to use their own tag line right back at them for abolishment if the registry by saying; “If it saves just 1 life and family” (don’t forget a wife was murdered along with her registrant husband).
I am not for private registration either as that will still require periodic registration as well as stamps on your passport and/or drivers license. We lived without a registry prior to the 1990’s and we can live without one again. Period.
Lots of people commit lots of different crimes. Crimes will never stop happening. People will not stop being born and growing up to potentially commit crimes (even if petty), so stop picking on one sole criminal act as if its the ONLY crime anyone is entitled to know about for their so called “protection”.
Who is in danger of the teenagers that got caught having sex in pubic? Or even the adults?(remember the couple on the beach a few years ago?) yeah. Where is the “danger” from such acts? These are the types of things getting harmless people on the hit list and ruining their lives. No travel, branded IDs, not being allowed to go into a hospital when your wife is giving birth, not being able to get certain benefits, not being able to get business loans, etc. all because you got caught screwing on a beach. Or had a consensual affair with a post pubescent teen a year shy of the states legal age. Or were lied to by the teen and maybe even shown false IDs that the teen obtained (never forget Traci Lords and what she did because people who aren’t legal age to consent also don’t understand what they’re doing sarcasm).
I say we start using their own tag line right back at them. Suppose the next registrant to get killed is with his child and wife and the child is then put in harms way of a bullet. Will the legislature care then? Probably not. So now it’s time to stop kissing their asses and overdoing it with the professionalism and start telling it like it is right. to. their. faces.
Greetings ladies and gentlemen,
Last month I was able to secured a granting to early termination of my probation. I was ecstatic to say the least, and felt like I was almost a free man again….and note that I say “almost” a free man.
Today, this morning at around 6:30 am I got the visit of my newly appointed glorified babysitter with all the bells and whistles on his body, flack vest, big white flashy letters with “SHERIFF” emblazoned in it and nicely decorated with a Glock pistol in front of it and what could not be missing was the pair of handcuffs. The deputy who came by wanted to see that I was the person living at the residence where he was standing. He was clear that he wanted to be known as the person in charge of the area, and if I stepped outside of the boundaries, he will issue a warrant for my arrest.
Let me say this, I did two combat tours in Iraq….13 months in 2005 and 15 months in 2008….those who have been in combat knows the combat jitters and that after few mortars, couple rockets, few IEDs, those jitters usually subsides, however, in this particular case, after this deputy came by, my “post arrest jitters” came back and took away the little sense of safety I was enjoying. My Probation Officer always made the point that if I screwed up, I will be in prison “for a loooong time”…and this guy, brought back those memories….and right now I am struggling to not drag my head to a dark place just like I felt when I came back from Iraq…..
I sure hope that one day, all this will be over…..
Manny – if you read last week’s Weekly Update (https://floridaactioncommittee.org/weekly-update-2020-05-14-ref88/) you will see that you are not alone.
Hang in there… one day, all of this will be over.
Wow. I’m not going to let law enforcement criminals (LECs) wake me up at 6:30 in the morning. They can’t near my home unless I let them.
Wouldn’t it be great if all People Forced to Register never allowed LECs to get near them? That is how it should be. How would that change the perception of the Registries?

Hahahaha, no it hasn’t. Americans of every political persuasion stand in solidarity with Mr. Fairbanks. Mattieo’s own daughter won’t shed a tear for his death. None of your families would react any differently. Your lives don’t matter. Be sure to thank a cop today. The Thin Blue Line is all that stands between you and justice, but not always.
I see we have a vigilante.
Troy, I’ve had to remove some of your other posts because they directly responded to an individual and contained threats. You are very welcome to share your thoughts in our forum and we encourage an open discussion and contrasting points of view, but you can’t come here to threaten anyone.
Thank you FAC for again playing traffic cop on what appears to be an incoming barrage by some misguided, misinformed, troubled individuals.
Oh I so want to reply but I shall contain my civility.
I am with you Captain…..I had to get up from my computer several times and go have a cigarette. In fact I smoke most of them while my blood pressure rises, LOL. To me this country has never progressed past the Middle Ages….the puritanical zealots are still performing the Salem Witch Trails from the 1690’s and they do not even realize it. So sad to be that uninformed…..
Hi troy, You are right we should be thanking cops because they are the ones protecting people such as yourself who are nothing but key broad warriors and cyber bullies. I learn that those who point the finger have something to hide themselves, what you hiding??????
Who knows Troy you might be on the registry some day…. It is not those on the registry who committing crimes but those who are not. Also speaking of cops some of them had fallen to commit some sex crimes themselves Like you said it is a thin line between justice Here in AZ state we have law call “stand your ground. Some of us in our 50’s and 60’s well are old school you get the idea….. besides that have a nice day 🙂
It won’t be long before James Fairbanks will be forgotten, with hardly anyone left to “stand in solidarity” with him. Certainly no one will stand in solidarity with “Troy Moore”— we’ve all known people like him, and there’s a reason they have few friends.
With all due respect to the real Troy Moore, I think this poster is hiding behind the name of someone he does not like.
Troy you represent an ignorant and criminal view of mob mentality. You also display mental issues that require professional help. Your fixation on Registrants is nothing more than misplaced aggression for your own personal problems.
Get help.
BTW that uneven texting style to make your statement look spooky was unoriginal and pathetic.
You clearly have done zero research on this topic. I would suggest you educate yourself before you speak. Your lack of knowledge is showing.
As far as the daughter is concerned, yes. She will shed a tear. I speak from the wife of a SO who has a daughter who thinks her Daddy hung the moon. What point do you speak from?
Also, my husband got on the registry after 3 tours in Iraq and Afghanistan. He did not transition to civilian life well and made a stupid mistake. If you took the time to actually research, you will find that a majority on the registry are former military. These men and women need to be treated and supported through this because they have literally sacrificed of themselves for us.
Again- research before you speak.
Also I thank your husband for his service to our country.
Troy, maybe you should demand equal treatment for Fairbanks since he was only trying to do his “citizen’s duty”. If I am not mistaken, intentional taking of a human life…murder…is worth a life term in prison unless the death penalty is doled out. That would be only fair. By the way, when a registered citizen completes a sentence, that RSO can be retained indefinitely for what the RSO may do in the future. From the tone of your message it sounds as though you may just be a potential vigilante ready to commit a crime, so maybe you should be retained for what you may do. Mr Condoluci was murdered for what Fairbanks thought he may do in the future so what is good for the goose is good for the gander.
A Navy officer defending a pedophile is the least surprising thing I’ve seen today, honestly.
Troy Moore, there is not a single person in this thread who has defended Mr. Condoluci’s past criminal actions.
FAC, I appreciate your allowing Mr. Moore to present his contrasting point of view. It is probably time for him to now step down from the podium that was so graciously given to him.
Troy, you obviously do not know the definition of a pedophile and your ignorance is made quite obvious with each of your postings.
Is there anything sadder than the scum of the earth trying to pathologize anybody else’s behavior? I’m having white the laugh at these sad attempts at armchair psychology.
Y’all, I don’t think we should respond to this man. He is clearly uneducated and wants to stay in his stupidity. People like this aren’t worth our time or energy.
Looks like we struck a nerve with you, “Troy Moore.” You are accusing others of defending child sexual abuse because you just don’t get it. In your frustration you refer to others on this forum as “scum of the earth” who “don’t deserve to live.” We’ve all known enough guys like you that no armchair psychology is needed.
“When the debate is lost, slander becomes the tool of the loser.”
Socrates
Troy that means you are the loser here.
Clearly Troy Moore’s words are a true reflection of his own insecurities. Because he is such an insecure person, he feels the need to, within his own imagined rights, to express what is inside his twisted, irrational and illogical head.
People that are so insecure, as Mr Moore clearly is, wants to pretend that are doing a favor to society’s by confabulating a series of senseless words that only makes sense on his head, but for everyone’s else, is totally irrational.
His insecurity clearly tells a tale of the kind of man Mr Moore really is. Just picture in your head the description of this person and most likely, you’ll be right.
For the rest of us, who everyday have to deal with much bigger and important issues, we can’t afford to be bothered by the meaningless, irrational childish babbles of this little guy who wants to pretend to be something or someone and that is actually a nobody out of the backwoods of somewhere.
That is just my thoughts…
So funny. I won’t be thanking any law enforcement criminals any time soon. They should probably just fuck themselves.
There is no reasoning with an idiot. If you go to a news article with a comment section, even those who say they hate registered persons but believe we should not be engaging in vigilante violence are bashed as “pedifiles” or “pedo sympathizers” (most vigilantes can’t even spell “pedophile” much less understand what it means).
I’m sure most of you that have been around a few years like me remember the “Valigator.” Well, many people approach this subject like she does. If you don’t want to throw registered persons in a woodchipper feet first (to quote one of my “newest fans”), then you sympathize with “preditors” (vigilantes can’t spell) and you should be killed as well.
I can’t tell FAC what to do, but on my pages, trolls and vigilantes get blocked immediately. After well over a decade of doing this activism gig, I’ve heard it all by now.
There was a time I would willfully engage in arguing with these idiots but I’m getting too old for the petty social media crap by people who cspeak largely in GIFs and Emoji because they benefited from the “No Child Left Behind” education system. . There is only one thing these vigilantes are useful for, and that is providing the hard evidence we need as proof the registry needs to be abolished. Every one of them sending me nasty messages is helping my cause more than helping theirs.
The Nebraska legislature plans on returning on July 20. I know many FAC members work outside the boundaries of Florida. Nebraska is a small state population-wise, with 1.8 million people and roughly 5000 registered persons. We have a unicameral legislature– no House, just a Senate. That means we only get one shot to push for an end to the public registry in this state. If we can knock down the public registry in just one state, we can set a precedent that could lead to the complete abolition of the public registry.
I am confident that the dumber a person is, the more likely it is that the person is a Registry Supporter/Terrorist. Only truly stupid people think Registries are good, or if a person has any sense and does, then he/she is likely immoral and making $$$ from it.
Decent people don’t support Registries. Unfortunately, America is the land of the immoral, know-nothing idiots. They are a cancer that breeds.
I live in a New Jersey town that was one of the first places the registry was used to attack someone. The men who savagely beat a man where shocked to find out they had gotten the wrong man, a total innocent, who just happened to be living at the same address. The consequences for the men were minor while they should have been charged with a hate crime, they got simple assault and a lenient sentence.
