Ex Post Facto II Trial and Meetings in Tally

Dear Members and Advocates,

Who is ready to go to Tallahassee?

November is the month for Tallahassee and nearby counties to come together.  First, we have a Meet and Greet planned for Saturday November 11 from 1-4pm.  There will be FAC Board members there to share goals for the 2024 Legislative Session and how local members can get involved, whether just by making phone calls, or attending sessions to observe and take notes, or to stand up and make a 3-minute public statement.  We need more support from local residents of Tallahassee this year and hope that all local members will attend the Meet and Greet or at least contact the membership team.  For out-of-towners, hotel reservations are a challenge since there is a home football game that weekend and most of the rooms are already sold out for Friday and Saturday nights.

Hotel rooms will open up on Sunday November 12 and FAC has reserved a block at one hotel for any out-of-towners that can attend the long awaited trial for the Ex Post Facto II Lawsuit, scheduled to start on Monday November 13, 2023 at the Northern District court in Tallahassee.  There will be a team of attorneys, plaintiff and witnesses in the courtroom, and we expect to fill the public seats with FAC members and advocates in attendance to show support.  If you are interested in attending the trial in Tallahassee, please contact us.

WHAT YOU CAN DO:  Every month, try to attend or speak at one Legislative Delegation meetings and respond to at least one Call-to-Action. Contact the Legislative team if you need help preparing a 2-minute speech.  The call to action this month is focused on Contacting Florida Legislators to Make Changes so That People on the Sex Offender Registry Can Receive Long-Term Health Care.

THE POWER OF ONE:  If every member attended one delegation meeting and/or made one call to their legislator each month, our presence and voices would certainly speed up the change that is happening.  Years ago, any proposed restriction or law would pass immediately without pause or discussion….but no more.  We are seeing change happen in county and city meetings where decision makers are not so quick to agree to more restrictions; instead they are questioning the need, asking for more data, and searching for rational changes. Our voices are being heard locally and we need to have stronger voices in Tallahassee, too.

    Here is my take. Whether I like it or not, God sets up rulers and he pulls down rulers. I believe this is true for leaders of nations, state and local governments and judges as well. The only thing that is going to change the tide in this battle is prayer. Unless God moves on the hearts and minds of the Justices and Judges to recognize the injustice of the registry and its components and those justices and Judges rule in favor of Justice which obvious in my mind would be to abolish the registry for those before 1997, and set the system up to apply the registry and its components to those offenders who offended during those time frames: ie not ex post facto laws or after the fact laws.

    I also do not ever feel the Registry should be for life. I goes against my Christian belief in forgiveness, attonment, and reconcillation. So what can we do! Yes, show up support our attorneys whom I believe have been appointed by God, contact legislators, but most of all Pray that Justice will be done.

    Will a ruling finally be made concerning this issue – OR will we wait another decade or two? If we don’t win this I am DONE. I will officially give up. Seriously

      This ruling will not do away with the Registry in Florida. however it could define some things and help in that aspect. Remember this is the same Judge who ruled in the Delgado case a few years ago. While he left the internet Identifiers intake he did define them as social in nature. So I can see something like that coming out of this case.

    I know that closing arguments were supposed to be this morning (Nov 15). A lot is going on in Tallahassee right now. Once people return home, we should be hearing something.

    I believe this is a bench trial correct? If so does FAC have an idea on how quickly he will decide the case? I imagine win or lose both sides will fight on regardless of this round ruling.
    I can only hope it’s going into the fourth day is because we have so much evidence against the state we need more days for it (ha ha.)

      Nothing else has come out since my Thursday, Nov. 16, comment was posted.

        So the trail went on and closing arguments happened. That is great any insight on the types of questions Judge Hinkle asked each side? That is a huge window into his thinking and possible ruling direction

    Did anyone attend the trial in Tally last week? How do you think it went? Did the judge seem intrigued by our pleas?

    Interesting. Is expo facto case. What may mean if ruled favorably as it should be, is that wherever rules the Fl SOR law implied at time you accepted or got convicted is the law that applies to you. Any other changes that was made to it after over the years is a violation of continued doctrine or something in that respect. However, I may be wrong.
