MyLife.com Faces Class Action for Falsely Implying Man Was a Sex Offender

A website that offers to show you someone’s “reputation” and criminal history for a fee must face class action claims, after it allegedly suggested a Minnesota man was a sex offender when he only has traffic tickets. In a Tuesday ruling, Minnesota federal Judge Susan Nelson rejected MyLife.com’s motion to dismiss Plaintiff Brion Finlay’s proposed class action against the public information company.

Nelson said MyLife’s profiles and “Reputation Scores” amount to a consumer report, while MyLife operates as a consumer reporting agency, so it can also be sued under the Fair Credit Reporting Act, as well as for defamation.Finlay brought the class action in May, claiming his MyLife profile incorrectly implied he had both a criminal and sex offender background, and alleging a similar situation has likely happened to many others.

    There are probably many that have been damaged by this and similar false or extremely over exaggerated reports that have damaged hundreds of thousands . Do we really need more proof that the registry hit list is punishment?

      FTR, how did the same thing happen to you on E Harmony? Are you an citizen who is forced to register by court order? Or are you not required to register but were wrongfully branded a sex offender by E Harmony?

        Well the lawsuit does imply credit reporting. When the 3 majors begin to report “…offender” how many lines of credit will you have then? I applied for loans from Bank of America, mid florid and suntrust and was within days coldly refused by all 3. I wanted 100k equity line on my house which is paid off, 500k, I own lots and beacon in the 800s. They have to be judging me on past “criminal” history which I believe is done as a background check. I’ve had zero problems until 3 years ago. I also have had trouble getting 3 license plates day of sale. The last purchase I was able to transfer my tag easily but prior to that the dealership couldn’t figure out why and took hours usally reukting in a temp tag (another post).

    Just goes to show that the average citizen KNOWS the label is a life-ending impediment that causes irreparable harm and damage to one’s reputation, credibility and integrity.

    It’s the lowest bar one can reach in society.

    Happened to me in Jersey. My company took on a new client that required all employees of my company to get background checks. I had a knot in my stomach I knew my past from the 90’s would be flagged. Sure enough they called me into HR and it came up I was a sex offender from Florida. The VP that hired me only had knowledge of my past. But now HR had their hands on the info too. I calmly told HR lady per NJ law you can only back 7 years, and if there was an issue, I handed her my lawyers business card. She then omitted from my screening and it was never discussed again.
